Who's Eligible For Alternative Sentencing?
Remember that Alternative Sentencing Programs are punishment
that must fit the crime and are not ordered for just the
following situations. Finding the right strategy for an
Alternative Sentencing Program that both the judge and
prosecutor will approve of is a job for a skilled attorney
working with rehab professionals. Here are some examples
of cases that would be eligible for Alternative Sentencing
Programs.
Drug offenders who have not committed "serious"
crimes and do not have a mandatory sentence imposed
on them are eligible.
Drug offenders who have not committed multiple crimes
are candidates for Alternative Sentencing Programs.
Drug offenders who haven't committed a serious felony,
with or without the use of a weapon may receive an Alternative
Sentencing Program in lieu of jail time.
Drug offenders who do not pose a risk to themselves
or society are eligible for Alternative Sentencing.

Drug Court Approved Rehab, Probation

An arrest for a drug possession charge can seem like it's
the end of the world as one knows it. With the humiliation
of the arrest itself, being jailed, the cost of the bail
bondsman, the attorney's fees and just the idea of having
to do jail or prison time why wouldn't it seem that way?
The truth is, often a conviction for a drug related arrest
that lands the offender in a court approved rehab that offers
alternative sentencing (or a nudge from the judge as it
is sometimes called) can be the beginning of a new life
that the addict didn't even know existed.
Court Approved Rehabs and Probation Approved
Rehab Programs require the participants to be housed in
a facility geared mainly for defendants with alcohol and
drug abuse problems. Here, there will be individual and
group therapy sessions, along with required house chores,
house rules and strictly enforced curfews.
Participants may also be required to complete
a series of drug educational programs for a period of time
determined by the court. When the defendant completes all
required classes and programs, charges may even be dismissed.
If all classes are successfully completed the conviction
could possibly be avoided altogether.
